Customization Terms and Conditions

Introduction

These terms and conditions outline the rules and regulations for the use of our embroidery, vinyl and screen printing services. By accessing or using our services, you agree to comply with and be bound by the following terms and conditions. If you do not agree to these terms, please do not use our services.

Definitions

  • Client: The individual or company requesting the vinyl and screen printing services.

  • Service Provider: The company offering the vinyl and screen printing services.

  • Artwork: The design or image provided by the Client for vinyl or screen printing.

  • Proof: A digital sample of the final product provided to the Client for approval before full production .

Artwork Requirements

  • All artwork must be provided in high-resolution format (minimum of 300 dpi) and in an editable vector file.

  • The Client is responsible for ensuring that the artwork is free from any copyright infringement.

  • Any changes or adjustments to the artwork after submission may incur additional charges.

Proof Approval

  • Clients will receive a proof of their design for approval before full production begins.

  • It is the Client's responsibility to review the proof carefully for any errors or omissions.

  • Once the proof is approved, the Service Provider will not be held responsible for any mistakes or changes requested by the Client.

Production and Turnaround Time

  • Production time varies depending on the complexity and quantity of the order. An estimated turnaround time will be provided upon order confirmation.

  • Rush orders are available for an additional fee, subject to the Service Provider's capacity and discretion.

  • The Service Provider will not be held responsible for any delays caused by unforeseen circumstances or issues beyond their control.

  • All orders are subject to product availability. If an item is out of stock or unavailable, we will notify you as soon as possible and offer alternatives or a full refund.

Payment Terms

  • A deposit of 50% of the total order amount is required upon order confirmation.

  • The remaining balance is due upon completion of the order, prior to shipment or pickup.

  • Payments can be made via credit card, bank transfer, or other accepted methods as agreed upon with the Service Provider.

Shipping and Delivery

  • The Client is responsible for all shipping and handling costs unless otherwise agreed upon.

  • The Service Provider will provide an estimated delivery date upon order confirmation. However, they are not responsible for any delays caused by the shipping carrier.

  • The Client should inspect the delivered products upon receipt and report any damages or discrepancies within 48 hours.

  • No international shipping available at this time.

Returns and Refunds

  • Custom embroidered, vinyl, laser engraved and screen printed items are non-refundable unless there is a defect or error caused by the Service Provider.

  • In the event of a defect or error, the Client must notify the Service Provider within 5 business days of receiving the order.  This applies for non-branded special ordered merchandise.

  • Non-customized, unbranded products can be return for full refunds within 30 days. 

Order Cancelations

  • Once we receive payment for your order, we will begin processing it immediately and therefore cannot be canceled.

Wear and Tear

At Gear Up Nation, we take pride in delivering high-quality embroidered goods designed to withstand regular use. However, due to the nature of fabric and thread, some wear and tear over time is inevitable. This Wear and Tear Protection Provision outlines the extent of coverage for embroidery durability.

  • Provision of Services

  • The Service Provider guarantees that all embroidery, vinyl, screen printing services will be performed with the highest quality materials and craftsmanship. In the event that a decoration is found to be defective or not up to the agreed-upon standards, the Service Provider will offer a replacement or refund at their discretion.

  • Vinyl Printing Coverage:

    • Vinyl prints are highly durable, but they are not immune to wear and tear over time. Factors such as frequent washing, exposure to harsh chemicals, and excessive friction can affect the longevity of the prints. It is recommended to follow the care instructions provided by the Service Provider to ensure the prints last as long as possible. Generally, it is advisable to wash vinyl-printed items inside out on a gentle cycle and avoid using bleach or fabric softeners.

    • We guarantee against defects color change, lifting or other for a period of 30 days from the date of delivery.

 

  • Embroidery Coverage:

    • Our embroidery is designed to last through normal wear, washing, and use.

    • We guarantee against defects in stitching, unraveling, or significant thread breakage for a period of 30 days from the date of delivery.

    • If embroidery becomes loose or damaged under normal conditions during this time, we will repair or replace the item at our discretion.

  • Exclusions:

    • This provision does not cover damage resulting from:

      • Excessive friction, sharp object contact, or snagging.

      • Improper washing, drying, or exposure to harsh chemicals.

      • Normal fabric deterioration, including fading or pilling of the base garment.

      • Intentional misuse, alterations, or modifications by the end user.

To initiate a claim

  • Must be within the timeframe described above.

  • Refunds or replacements will be issued at the Service Provider's discretion after verifying the claim.

  • Submit a request with a photo of the damaged decoration, the number of impacted pieces and a brief description of the issue.

  • If approved, we will offer a repair, replacement, or store credit as appropriate.

Intellectual Property

  • All artwork and designs provided by the Client remain the intellectual property of the Client.

  • The Service Provider reserves the right to use the Client's designs for promotional purposes, unless otherwise requested by the Client in writing.

  • The Service Provider retains the intellectual property rights to any original designs created by their team.

Governing Law

  • These terms and conditions are governed by and construed in accordance with the laws of the jurisdiction in which the Service Provider operates.

  • Any disputes arising from these terms and conditions will be subject to the exclusive jurisdiction of the courts in that jurisdiction.

Modifications

  • The Service Provider reserves the right to modify these terms and conditions at any time. Clients will be notified of any changes via email or through the Service Provider's website.

  • Continued use of the services after any changes to the terms and conditions will constitute acceptance of the revised terms.
